On Thursday, October 10, 2024, the Board of Immigration Appeals issued an order immediately suspending Attorney Alex R. Hernandez Jr. from practicing law before immigration courts and the Department of Homeland Security. The BIA took this action in response to a joint petition filed by the disciplinary counsel for the Executive Office for Immigration Review and DHS.The case is entitled “In the Matter of Alex R. Hernandez, Jr.”According to the order, Hernandez was disbarred from practicing law in Texas by the State Bar of Texas’ District 11-1 Grievance Committee Evidentiary Panel on July 12, 2024. As a result of losing his license in Texas, the BIA determined there were grounds to suspend Hernandez’s ability to represent clients nationally in immigration courts and before DHS, pending further review.The BIA instructed Hernandez to inform any clients with ongoing immigration cases that he can no longer represent them. He must also provide proof that he properly notified affected clients. Additionally, the suspension order stated that information about the disciplinary action would be publicly disclosed at immigration courts and DHS offices.
